Purpose of this privacy notice
This privacy notice explains what information we collect about you, how we store this information, who we share this information with and how we keep it safe and confidential. We want you to be confident that your information is kept safe, secure and for you to understand how and why we use it.
It sets out how Knowsley Council and the Knowsley SEND Partnership will use data collected from respondents completing surveys and participating in focus groups/interviews.
You can decide whether to complete the survey; and you can decide how much or how little you wish to complete.
The Knowsley SEND Partnership includes Knowsley Council, NHS Cheshire and Merseyside Integrated Health Board, Alder Hey Children’s Hospital, NHS Merseycare and local SEND schools Alt Bridge, Bluebell, St Margaret Mary and Knowsley College.

What type of information will you be processing?
Questions in the survey are not mandatory, you may choose to complete all, part or some of the survey. The types of data we will collect include the following:
- Personal data. The survey may appear to be anonymous as we will NOT be asking for any personal details, e.g., your name, date of birth, address etc. However, we may be able to identify you through the collective answers you provide on the survey, therefore we are required to make you aware of this.
- Special category data. Health details such as any diagnosed or recognised Special Educational Need and/or Disability (SEND) or condition you choose to disclose concerning yourself or a young person you work with or who is in your care. This information is being collected with the aim of improving services and will be analysed for this reason only.
Your participation in the survey or focus group is entirely optional, by participating you are consenting to the information provided being used.
Why do you need my information?
We may need to use the information you provide to us, to:
- Inform the Joint Strategic Needs Assessment for Preparing for Adulthood in Knowsley. Knowsley Council has a statutory duty to deliver Joint Strategic Needs Assessments which fall under Part 5, Chapter 2 (192) of the Health & Social Care Act 2012.
- Meet Knowsley Council’s requirements under The Equality Act 2010 which states that public authorities have a specific legal duty to publish information about how people are affected by policies and practices.
- Identify whether services, functions and policies are promoting equality of opportunity and good community relations and eliminating unlawful discrimination in line with the Public Sector Equality Duties under the Equality Act 2010.
- Help us ensure we are designing services around the needs of our communities.
- Achieve the Knowsley Council Plan vision of “effective support to those in need” and the priorities of:
- Ensuring that all Knowsley residents are able to access the support and services they need
- Meeting Complex Need – ensuring that residents who have complex needs receive effective support which empowers them throughout their lives
Knowsley Council will collect and analyse the consultation findings to understand the experience of parents/carers, staff/education providers and young people experiencing the Preparing for Adulthood process in Knowsley. The answers given will be used by Knowsley Council and the Knowsley SEND Partnership to help improve the way that we provide Preparation for Adulthood support to all Knowsley young people who require it.
The responses will also be used to inform the Joint Strategic Needs Assessment for Preparing for Adulthood which can affect decisions made at policy making and strategic level.
What allows you to use my information?
- Completing the survey is a voluntary act on your part to help us achieve our objectives relating to the continued improvement and development of the Knowsley SEND Partnership Services.
- By completing the survey or taking part in a focus group you are giving your consent for the data you give to be used.
- To allow Knowsley Council to meet our obligations under the Equality Act 2010 and Health and Social Care Act 2012.
The legal bases which allow the Council to lawfully process your data fall under the UK GDPR and the Data Protection Act 2018.
- Article 6 (1) a Consent.
By choosing to complete the survey, you give Knowsley Council consent to process the data you provide. As previously mentioned, this data will in the main be anonymised data.
After the survey is completed, the processing of any identifiable data is covered under:
- Article 6 (1) e Public Task.
To process personal data, such as your name, address, or any other personal identifier.
- Article 9 (2) h Health and Social Care.
To process special category data, such as your health data or any other more sensitive data which requires more protection.
This is by virtue of the Health and Social Care Act 2012 whereby the Joint Strategic Needs Assessment is a statutory requirement under Part 5, Chapter 2 (192). Statutory guidance is also published here.
Who will my information be shared with?
Aggregated and anonymous data will be used by Knowsley Council. Anonymised statistical data may be shared with the Knowsley SEND Partnership. The Council will not share the data with any other third party.
Do I have to provide this information and what will happen if I don’t?
No, participation is entirely voluntary and not a legal requirement. You can decide whether to complete the survey or participate in a focus group or not; and you can decide how much or how little you wish to complete.
How long will you keep this data for and why?
The anonymous data will be held by Knowsley Council for a period of up to 5 years following the end of the engagement and consultation period. Any paper surveys will be securely destroyed within 6-months of the closure of the survey.
How will my information be stored?
All paper surveys received will be stored securely by Knowsley Council in a locked filing cabinet and will be securely destroyed with the confidential waste by Knowsley Council once the retention period is met. Anonymised electronic survey data held by Knowsley Council will be stored on a secure electronic system.
Will this information be used to take automated decisions about me?
No
Will my data be transferred abroad?
No
What rights do I have when it comes to my data?
Once complete the data you submit on the Preparing for Adulthood consultation will be unable to be retracted. This includes any potentially identifiable person information as disclosed by you in terms of personal or special category data. All data will be aggregated and anonymous following the completion of analysis.
Under the Data Protection Act (DPA) 2018 / UK General Data Protection Regulation (UK GDPR), you have the following rights with regards to your personal data:
- The right to subject access – you have the right to see a copy of the personal data that the council holds about you and find out what it is used for
- The right to rectification – you have the right to ask the council to correct or remove any inaccurate data that we hold about you.
- The right to erasure (right to be forgotten) you have the right to ask the council to remove data that we hold about you
- The right to restriction – you have the right to ask for your information to be restricted (locked down) on council systems
- The right to data portability – you have the right to ask for your data to be transferred back to you or to a new provider at your request
- The right to object – you have the right to ask the council to stop using your personal data or to stop sending you marketing information, or complain about how your data is used
- The right to prevent automated decision making – you have the right to ask the council to stop using your data to make automated decisions about you or to stop profiling your behaviour (where applicable)
