This Privacy Notice covers the collection of personal data from individuals responding to our invitation to apply for a social work position with Knowsley Social Care.

Personal data is information that, either on its own or when added to other information, can identify a living individual. This can include names, addresses, phone numbers, email addresses, dates of birth, etc.

Knowsley Council takes data protection seriously. Please be assured that your information will be used appropriately in line with data protection legislation, will be stored securely and will not be processed unless the requirements for fair and lawful processing can be met.

Why do you need my information?

As part of the application process, we will collect the following personal data from you if you choose to book an interview for the position of social worker:

  • Name
  • Email address
  • Phone number
  • Social Work England registration number - if appropriate
  • If you are due to qualify as a social worker this year

If you are invited for an interview, we will contact you to ask if you have a disability or if any support is needed to enable you to access your interview.

How will your information be used?

Your personal data will help us:

  • To identify suitability for the social work roles we have available.
  • Identify any individual needs that we can support for you to participate in the interview process.
  • Contact you before the event to confirm your interview time and date.
  • To contact you to advise you to submit a copy of your CV.
  • Let you know about any other roles we have in the future.
  • If you are successful at the interview, your details will be forwarded to our HR department; they will be in touch with you to request further information as part of our recruitment process.

What allows you to use my information?

The lawful basis we rely on for processing your personal data is article 6(1)(b) of the UK GDPR, which relates to processing necessary to perform a contract or to take steps at your request before entering a contract. And article 6(1)(f) for the purpose of our legitimate interests.

If you provide us with any information about reasonable adjustments you require under the Equality Act 2010, the lawful basis we rely on for processing this information is Article 6(1)(c) to comply with our legal obligations under the Act.

The lawful basis we rely on to process any information you provide as part of your application, which is special category data, such as health, religious, sexual orientation or ethnicity information, article 9(2)(b) of the UK GDPR, which relates to our obligations in employment and the safeguarding of your fundamental rights or Article 9(2)(g) - necessary for reasons of substantial public interest.

The additional DPA 2018 processing conditions we rely on are Schedule 1, part 1(1), which again relates to processing for employment purposes and Schedule 1, part 2, paragraph 6 – statutory etc and government purposes.

We process information about applicant criminal convictions and offences. The lawful basis we rely on to process this data is Article 6(1)(e) for the performance of our public task. In addition, we rely on the processing condition in Schedule 1 part 2, paragraph 6(2)(a).

If you wish to receive information on future vacancies, we will only process your data where we have your consent to do so. We will gain your consent for processing your data and manage this consent on an ongoing basis under Article 6(1)(a) of the GDPR.

Who will my information be shared with?

If you are not invited for interview your data will not be shared.

If you are invited for interview your data will be shared with Knowsley staff involved in the recruitment process.

Your information may also be shared with other organisations where it is lawful to so for example Disclosure and Barring Service. 

Your information will not be used in any other way unless it is lawful to do. 

Do I have to provide this information and what will happen if I don’t?

If you do not provide your contact details, we will be unable to confirm your interview time and date or make contact with you to inform you to submit your CV to us.

How long will you keep this data for and why?

If you wish to be informed about other roles in the future, we will hold your information for 12 months unless contact us to opt out.

If you are offered a position at the Council, your personal information will be held on the Council’s HR and Payroll systems.

Unsuccessful applicant data will be deleted from the recruitment system annually.

How will my information be stored?

Your information will be stored on secure Council systems.

Will this information be used to make automated decisions about me?

Yes. When you book your interview, part of the process will require you to answer questions to confirm if you meet the criteria for the role of social worker, i.e., that you have a social work qualification. If you do not have a social work qualification, you will be unable to book an interview.

What rights do I have when it comes to my data?

Under the Data Protection Act (DPA) 2018/ UK General Data Protection Regulation (UK GDPR), you have the following rights with regards to your personal data:

  • The right to subject access – you have the right to see a copy of the personal data that the council holds about you and find out what it is used for.
  • The right to rectification – you have the right to ask the council to correct or remove any inaccurate data that we hold about you.
  • The right to erasure (right to be forgotten) you have the right to ask the council to remove data that we hold about you.
  • The right to restriction – you have the right to ask for your information to be restricted (locked down) on council systems.
  • The right to data portability – you have the right to ask for your data to be transferred back to you or to a new provider at your request.
  • The right to object – you have the right to ask the council to stop using your personal data or to stop sending you marketing information, or complain about how your data is used.
  • The right to prevent automated decision making – you have the right to ask the council to stop using your data to make automated decisions about you or to stop profiling your behaviour (where applicable).
