Who will own my data?

Why do you need my information?

Tracking young people’s participation is a statutory requirement for Knowsley Borough Council. The Council is required to collect and hold information regarding education, employment and training for;

  • young people following them leaving compulsory education for up to three years
  • young people up to age 25 for those with Special Educational Needs and Disability

The data will be used to track young people in education, training and employment, assist young people who are not in education, employment and training, signposting and providing programmes, using summary data to provide statistics both internally and for the Department for Education.

What information will you collect or be provided with?

  • Name/alias
  • Contact details, including mobile number and email address
  • Date of birth
  • Address 
  • Education, skills and employment information including SEND 
  • School and early years placements 
  • Disability and health information/medical history
  • Ethnicity
  • Religion
  • Involvement with Youth Justice Service 
  • Information relating to any safeguarding concerns. This could include criminal offence data. Knowsley Council processes criminal offence data as an official authority.

What allows you to use my information?

The council has a duty from National Government to collect this information to be able to identify young people who are not in education, employment or training and then support them into appropriate opportunities. 

(Section 68 Education and Skills Act 2008 as updated by Section 20 of the Children and Families Act 2014)

Personal information is being processed in line with the following lawful basis that is available under the UK General Data Protection Regulation: 

Article 6 (1) (c) processing is necessary for compliance with a legal obligation to which the controller is subject

Article 6 (1) (e) processing is necessary for the performance of a task carried out in the public interest or in the exercise of official authority vested in the controller.

Special category personal information is being processed in line with the following lawful basis available to us under the UK General Data Protection Regulation:

  • Article 9(2)(g) states that processing is necessary for reasons of substantial public interest.

Special category personal data in relation to personal that that may be processed under this agreement includes, but is not necessarily restricted to, the following:

  • Ethnicity.
  • Health and medical information (information about physical health, mental health, and historical trauma.  
  • Safeguarding information.

Who will my information be shared with?

  • Engagement Team including those working under contract to the Council e.g. Career Connect, Elevate EBP.
  • Service providers, e.g. training providers, colleges, schools
  • Other council services
  • Other Local Authorities – where young people move to their area and only through the DfE secure National Client Caseload Information System (NCCIS)
  • Service provider,s e.g. training providers, colleges, schools, DfE

Do I have to provide this information and what will happen if I don’t?

We would normally receive this information from your secondary school just before you leave. This will include address and contact phone numbers which assist us in making contact and help us to refer you to possible opportunities, provision and if appropriate other Council services. Not having this information could mean you don’t get the assistance you may need.

You can opt out of using our service at any time by advising us that you do not require support. Under our duty we will contact you at set intervals to see if you are in Employment or training or to check if you need any support at that time.

How long will you keep this data for and why?

Personal data will not be retained for longer than necessary in relation to the purposes for which they were collected. We only hold information as long as it is needed or required by law and then dispose of it securely.

How will my information be stored?

All information is kept electronically. We use a database that is secure and accessed only by managed user registration and a series of passwords. We currently use the EYES module in the System C database.

Will this information be used to take automated decisions about me?

No

Will my data be transferred abroad?

No

What rights do I have when it comes to my data?

Under the General Data Protection Regulation, you have the following rights with regard to your personal data: 

  • The right to subject access – you have the right to see a copy of the personal data that the council holds about you and find out what it is used for.
  • The right to rectification – you have the right to ask the council to correct or remove any inaccurate data that we hold about you.
  • The right to erasure (right to be forgotten) you have the right to ask the council to remove data that we hold about you.
  • The right to restriction – you have the right to ask for your information to be restricted (locked down) on council systems.
  • The right to data portability – you have the right to ask for your data to be transferred back to you or to a new provider at your request.
  • The right to object – you have the right to ask the council to stop using your personal data or to stop sending you marketing information, or to complain about how your data is used.
  • The right to prevent automated decision making – you have the right to ask the council to stop using your data to make automated decisions about you or to stop profiling your behaviour (where applicable)
