  • To Investigate and respond to Adult statutory complaints
  • To investigate and respond to Children’s statutory complaints
  • To take the learning from any complaint – which will assist in the review, development and improvement of Council Services
  • To complete an annual report which is a statutory requirement for Adult and Children Statutory complaints

  • National Health Service Complaints (England) Regulations 2009 No 309
  • Children (Leaving Care) Act 2000
  • Adoption and Children Act 2002
  • Children Act 2004
  • Health and Social Care (Community Health and Standards) Act 2003 Representations Procedure (England) Regulations 2006 to have a system for receiving complaints for adults and children’s social care service users or their representatives
  • Getting the Best from Complaints
  • Local Government Act 2009

Who will my information be shared with?

  • Services Areas within the Local Authority
  • North West Boroughs Health Service if related to a shared service
  • Local Government and Social Care Ombudsman

Do I have to provide this information and what will happen if I don’t?

If you do not provide the information required it may not be possible to respond to your complaint. 

How long will you keep this data for and why?

  • Complaints - Seven years
  • Ombudsman Representations - 15 Years

How will my information be stored?

  • All Corporate complaints, Adult and Children statutory complaints, Ombudsman complaints are recorded on a confidential database. This database has restricted access
  • Investigation reports and responses relation to complex complaints is stored on a SharePoint Site – this site has access limited to Customer liaison Team.

Will this information be used to take automated decisions about me?

What rights do I have when it comes to my data?

Under the General Data Protection Regulation, you have the following rights with regard to your personal data: -

  • The right to object – you have the right to ask the council to stop using your personal data or to stop sending you marketing information, or complain about how your data is used
  • The right to prevent automated decision making – you have the right to ask the council to stop using your data to make automated decisions about you or to stop profiling your behaviour. (where applicable)
